Terms and conditions for the Early Access Club and the associated sweepstakes of Quality First GmbH
1. Subject of the Terms of Use and Participation
1.1. Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany ("Organizer"), operates an online shop at https://morenutrition.de/ ("Online Shop"). The Organizer organizes a multi-part sweepstakes ("Sweepstakes") for participation in the Early Access Club and to promote its products via its own Instagram account morenutrition.de ("Instagram Account") and via influencers' social media channels.
1.2. During the entire participation period according to section 2.1, a total of up to ten (10) participation opportunities for the sweepstakes will be published on the Instagram account and on the influencers' social media channels ("Participation Opportunities").
1.3. The winners of the sweepstakes will become members of the Organizer's Early Access Club ("Early Access Club"). As such, they will have the opportunity to gain early access to the Organizer's online shop a maximum of one (1) time per month. Membership in the Early Access Club is valid from the date of acceptance of the prize and automatically ends at the end of the participation period on December 31, 2026, without requiring separate termination by the Organizer ("Membership Period").
1.4. The sweepstakes organized by the Organizer on Instagram account is not associated with Meta Platforms Inc. and its affiliated companies and is not managed, sponsored, supported or organized by Meta Platforms Inc. and its affiliated companies. All questions, comments, suggestions and complaints about the sweepstakes should be addressed to the Organizer, not to Meta Platforms Inc.
1.5. These terms and conditions regulate the conditions for participation in the sweepstakes as well as any necessary transfers of rights.
2. When can I participate in the sweepstakes?
2.1. The participation period for the sweepstakes is from 01/01/2026 at 00:00 to 31/10/2026 at 23:59 ("Participation Period").
2.2. The winners will be notified by email by the Organizer within three (3) working days after the draw of the sweepstakes.
2.3. The Organizer reserves the right to extend the participation period by notifying on the Instagram account. If the participation period is extended, the further prize handling and the membership period may change.
3. Who can participate in sweepstakes?
3.1. Any natural person who is at least 18 years old and has their residence in the Federal Republic of Germany, Austria or Switzerland ("Participant") may participate in the sweepstakes.
3.2. Each participant is entitled to receive the prize only once. Participation by the same person via different social media accounts is prohibited and entitles the Organizer to exclude the participant from the sweepstakes. Furthermore, only persons who have not yet received a prize may participate.
3.3. By participating in the sweepstakes, the participant accepts these terms and conditions.
4. How does participation in the sweepstakes work?
4.1. Participation in the sweepstakes is free of charge and is governed exclusively by these terms and conditions.
4.2. The sweepstakes will be published during the entire participation period every month from 01/01/2026 to 31/10/2026, i.e. up to ten (10) times, on the Instagram account and on the influencers' social media channels, providing multiple opportunities to participate.
4.3. For each participation opportunity, the participant must meet one of the following conditions for participating in the sweepstakes, whereby the exact condition will be announced with the respective participation opportunity:
Following the Organizer's Instagram account or the influencer's social media channel or
Liking, and/or commenting on, and/or sharing posts or story stickers on the Organizer's Instagram account or the influencer's social media channel or
Joining the broadcast channel on the influencer's Instagram account or
Following the Organizer's WhatsApp channel or
Placing an order in the Organizer's online shop or
Subscribing to the Organizer's newsletter.
4.4. By participating in the sweepstakes and accepting the prize, the participant enters into a contract with the organizer that grants the participant access to exclusive benefits for one calendar year.
5. How does the drawing and winner notification work?
5.1. All participants in the sweepstakes who meet the requirements specified in sections 3 and 4 at the time of the draw will be considered.
5.2. After the participation deadline, the winner ("Winner") will be determined by the Organizer from all eligible participants. The winner will be determined by drawing lots based on a random principle.
5.3. The winner will be notified by email.
5.4. Each notified winner is obliged to inform within two (2) working days after contact whether they accept the prize.
5.5. If it is not possible to contact the winner or the organizer does not receive a corresponding message within this period, the option to accept the prize expires and the organizer reserves the right to determine another participant and notify them accordingly.
5.6. Should the contact details provided by the winner (e.g. email address or postal address) be incorrect or untrue, the organizer is not obliged to ascertain the correct data. The disadvantages arising from the provision of incorrect contact data (e.g. undeliverability, return, etc.) shall be borne by the winner.
6. What is the prize or what is the Early Access Club?
6.1. The prize is a membership in the Organizer's Early Access Club, valid for one calendar year.
6.2. Early Access Club members have the opportunity to gain early access to the Organizer's online shop to secure desired products early.
6.3. Membership in the Early Access Club is granted exclusively through the sweepstakes. By participating in the sweepstakes and accepting the prize, participants enter into a contract with the organizer, which grants the participant early access to the online shop a maximum of once a month. Early access is valid for ten (10) minutes and is possible a maximum of once (1) a month, for a promotion specified by the organizer ("Early Access Promotion"). The organizer informs Early Access Club members about the respective Early Access Promotion via newsletter. One of the prerequisites for participating in the sweepstakes is subscribing to the organizer's newsletter to be informed about upcoming promotions, exclusive offers, and relevant updates. In addition, the participant has the opportunity to receive a free shipping order placed by them for twenty-four (24) hours during the Early Access Promotion, i.e., from Sunday, 10:50 AM to Monday, 10:49 AM. Free shipping is automatic and does not require a code. During membership, participants also have the opportunity to participate in sweepstakes about which the organizer informs via newsletter. The organizer will raffle off a maximum of four (4) products per year ("Product Prize") among all Early Access Club members. The product prize is to be determined by the organizer.
6.4. Cash payment, exchange or transfer of the prize is excluded.
6.5. The Organizer shall only be liable for damages incurred by the winner due to material and/or legal defects in cases of fraudulent intent, willful misconduct or gross negligence. Otherwise, liability for material and/or legal defects is excluded.
6.6. Each winner is responsible for any taxation of the prize.
7. Who can be excluded from the sweepstakes?
7.1. A violation of these terms and conditions entitles the Organizer to exclude individual or multiple participants from participating in the sweepstakes. This applies in particular if false information is provided or third-party rights (personal/copyrights) are infringed.
7.2. In addition, the Organizer may exclude individual or multiple participants from participating in the sweepstakes if the participation process and/or the platform is manipulated or an attempt is made to manipulate it, and/or these terms and conditions are violated, and/or an attempt is otherwise made to influence the sweepstakes or the execution of the sweepstakes in an unfair and/or unethical manner, in particular by interfering with the software used. In such cases, prizes may also be revoked and reclaimed retroactively.
7.3. Persons who do not meet the requirements set forth in sections 3 and 4 are excluded from participation.
7.4. Employees of the Organizer or an affiliated company, as well as other persons involved in the development and execution of these sweepstakes, are excluded from participation.
8. Early termination, adjustment or modification of the sweepstakes
8.1. The organizer is entitled to terminate, adjust or modify the sweepstakes at any time without prior notice and without stating reasons, if a proper execution of the sweepstakes cannot be guaranteed for technical or legal reasons without corresponding measures.
9. How is my data processed?
9.1. Membership in the Early Access Club is granted exclusively through the sweepstakes. By participating in the sweepstakes and accepting the prize (one-year membership in the Early Access Club), participants enter into a contract with the organizer, which grants the participant early access to the online shop once a month. One of the prerequisites for participating in the sweepstakes is subscribing to the organizer's newsletter. Through this newsletter, the organizer regularly informs participants about upcoming promotions, exclusive offers, and relevant updates that are important for Early Access Club members.
9.2. The processing of personal data (e.g., email address) is carried out on the basis of Art. 6 para. 1 lit. b GDPR, as it is necessary for the fulfillment of the contract between the participant and the organizer. The provision of participant data for the newsletter is thus a necessary condition for participation in the Early Access Club.
9.3. The participant's data will be used exclusively for the purposes of contract fulfillment and the provision of the newsletter. Unsubscribing from the newsletter simultaneously terminates membership in the Early Access Club, as the newsletter is a central prerequisite for the contractual service. Therefore, unsubscribing from the newsletter during the contract term is not possible.

10. Applicable Law and Jurisdiction
10.1 This sweepstakes is governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 The competent court is - where permissible - the District Court of Itzehoe, Germany.
10.3 The choice of law applies to consumers only to the extent that
they are not deprived of the protection of mandatory provisions of the state
in which they have their habitual residence.
10.4 The legal process is excluded.
11. Final provisions
11.1 Should individual provisions of these terms and conditions be invalid,
the validity of the remaining provisions remains unaffected.
