1 Subject Matter of the Terms of Use and Participation

1.1 Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (“Organizer”) organizes a prize draw. The prize draw will be published on the Organizer's website https://morenutrition.de/, the Instagram account @morenutrition.de, the TikTok account @morenutrition.de, the Snapchat account @morenutrition, and the WhatsApp channel @More (“Social Media Presence”).

1.2 The prize draws organized by the Organizer on the Social Media Presence are not affiliated with Meta Platforms Inc., TikTok Technology Limited, or Snap Inc. and their affiliated companies and are not responsible, sponsored, supported, or organized by Meta Platforms Inc., TikTok Technology Limited, or Snap Inc. and their affiliated companies. All questions, comments, concerns, and complaints regarding prize draws should not be directed to Meta Platforms Inc., TikTok Technology Limited, or Snap Inc., but to the Organizer.

1.3 These terms of participation govern the conditions for participation in the prize draws and any necessary rights transfers.

1. 2 Prize Draw Period
   

   2.1 The participation period for the prize draw is from June 8, 2025, 10:45 AM, to June 22, 2025, 11:59 PM.

   
   

   2.2 The Organizer reserves the right to extend the participation period by means of a corresponding announcement on the Instagram account. Should the participation period be extended, it is possible that further prize handling may change.

   
   
2. 3 Participation Requirements
   

   3.1 Any natural person who is at least 18 years old and resides in Germany, Austria, or Switzerland ("Participant") may participate in the prize draw.

   
   

   3.2 Only persons who have not yet received a prize can participate.

   
   

   3.3 By participating in the prize draw, the Participant accepts these terms of participation.

   
   
3. 4 Participation in the Prize Draw
   

   4.1 Participation in the prize draw is free of charge and exclusively subject to these terms of participation.

   
   

   4.2 Prerequisite for participation in the prize draw is the completion of the online participation form (Typeform) and an order placed during the promotion period on https://morenutrition.de/ that contains at least one promotional product. Promotional products do not include cookbooks or recipe books.

   
   

   4.3 All Participants in the prize draw who meet the requirements specified in sections 3 and 4 by the respective time of the drawing will be considered.

   
   

   4.4 After the participation deadline, the winner will be determined by the Organizer from all eligible persons. The determination will be made either by using a prize draw app from an external service provider or by drawing lots. In both cases, the winners will be drawn randomly.

   
   

   4.5 The winner will be notified by email.

   
   

   4.6 Each notified winner is obliged to inform within 2 days after contact, stating their first and last name, email address, and postal address, whether they accept the prize.

   
   

   4.7 If it is not possible to contact the winner or if the Organizer does not receive a corresponding message within this period, the possibility of accepting the prize expires, and the Organizer reserves the right to determine another Participant and notify them accordingly.

   
   

   4.8 Should the contact details provided by the winner be incorrect or untruthful, the Organizer is not obliged to ascertain the correct data. The disadvantages arising from the provision of incorrect contact details (e.g., non-deliverability, return, etc.) shall be borne by the winner.

   
   
4. 5 Prize
   

   5.1 The prize includes a ten-day trip to the Maldives for 2 people, including travel to and from, accommodation, and meals. The value of the trip is a maximum of € 10,000.00. The exact dates of the trip and further details such as travel to and from, accommodation, flights, etc. will be determined after contact with the winner.

   
   

   5.2 Cash payment, exchange, or transfer of prizes (both vouchers and material prizes) is excluded for all prize draws.

   
   

   5.3 The Organizer is only liable for damages incurred by the winner due to material and/or legal defects in cases of malice, intent, or gross negligence. Otherwise, liability for material and/or legal defects is excluded.

   
   

   5.4 The winner is solely responsible for any taxation of the prize.

   
   
5. 6 Exclusion from the Prize Draw
   

   6.1 A violation of these terms of participation entitles the Organizer to exclude individual or multiple Participants from participating in the prize draw. This applies in particular if false information is provided or third-party rights are violated (personality/copyrights).

   
   

   6.2 Additionally, the Organizer may exclude individual or multiple Participants from participating in the prize draw if the participation process and/or the prize draw page is manipulated or an attempt at manipulation is made and/or these terms of participation are violated and/or otherwise an unfair and/or dishonest attempt is made to influence the prize draw or its execution, in particular by interfering with the software used. In these cases, prizes may also be subsequently revoked and reclaimed.

   
   

   6.3 Persons who do not meet the requirements according to sections 3 and 4 are excluded from participation.

   
   

   6.4 Employees of the Organizer or an affiliated company, as well as other persons involved in the development and execution of these prize draws, are excluded from participation.

   
   
6. 7 Premature Termination, Adjustment, or Modification of the Prize Draw
   

   7.1 The Organizer is entitled to terminate, adjust, or modify the prize draw at any time without prior notice and without stating reasons if a proper execution of the prize draw cannot be guaranteed due to technical or legal reasons without corresponding measures.

   
   
7. 8 Data Processing
   

   8.1 Information on data processing can be found in the privacy policy at https://morenutrition.de/pages/datenschutzerklarung.

   
   

   8.2 The Organizer processes the data only for the execution and handling of the prize draw in accordance with Art. 6 Para. 1 lit. b GDPR. The data provided in the context of the prize draw will be deleted – subject to statutory retention obligations – when the purpose of processing this data has ceased or it is no longer necessary for the purpose.

   
   
8. 9 Severability Clause
   

   9.1 Should individual provisions of the terms of participation be or become invalid, the validity of the remaining terms of participation remains unaffected.

   
   

   9.2 Legal recourse is excluded.

   
   

   9.3 German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
